SONY - Activision drops amid report that UK may need to do a new probe of Microsoft deal

Activision ( NASDAQ: ATVI ) fell 1.2% in premarket trading amid a report that the UK's antitrust authority may need to do a new probe of the Microsoft ( NASDAQ: MSFT ) deal if the companies' restructure their deal to appease the regulator.

"Merging parties don’t have the opportunity to put forward new remedies once a final report has been issued, they can choose to restructure a deal, which can lead to a new merger investigation," a spokesperson from the Competition and Markets Authority said in a statement Wednesday to Bloomberg.

The report comes after the UK anti-trust authority  and Microsoft agreed to stay litigation in the UK regulator's attempt to block the combination.

Microsoft (NASDAQ: MSFT ) is offering to make a small divestiture to meet the objections of the UK's antitrust regulator to its planned Activision ( ATVI ) deal, CNBC's David Faber said Tuesday. Microsoft ( MSFT ) is offering a "small and discrete" divestiture to the CMA that it believes the regulator will accept.

Bloomberg also reported late Tuesday that the Federal Trade Commission is leaning toward appealing its court loss in the Activision ( ATVI ) deal as soon as Wednesday.
