HAP - BP to pay record $40M settlement in Whiting refinery pollution charges

BP ( NYSE: BP ) agreed to pay a record $40M penalty to settle civil charges that its Whiting refinery in Indiana violated federal laws aimed at curbing hazardous air emissions, the U.S. Department of Justice said Wednesday.

The $40M civil penalty is the largest ever secured for a Clean Air Act stationary source settlement.

The settlement between BP Products North America ( BP ), DoJ and the Environmental Protection Agency also will require the company to spend ~$197M on new technology and other capital improvements to reduce emissions of benzene by an estimated seven tons per year, other hazardous air pollutants by 28 tons/year and other volatile organic compound emissions by 372 tons/year at the Whiting refinery.

The company also agreed to undertake a $5M supplemental environmental project to reduce diesel emissions in the communities surrounding the refinery and install 10 air pollutant monitoring stations to monitor air quality beyond the refinery fence line.

BP's ( BP ) 435K bbl/day Whiting refinery is the sixth biggest by capacity in the U.S.
