China has published interim measures for managing generative Artificial Intelligence ((gen AI)) services which will go into effect Aug. 15.
The Cyberspace Administration of China (CAC) noted that industry organizations, enterprises, and relevant professional institutions which develop and apply generative AI technology, but do not provide gen AI services to the domestic public, shall not be subject to the measures.
The regulator added that the gen AI services should respect social morality and ethics and adhere to core values ??of socialism.
The services must not generate incitement to subvert state power, overthrow the socialist system, endanger national security and interests, damage national image, incite secession, among other things.
These measures comes after China signalled the end of its years-long crackdown on the tech industry, whose support the country is seeking to boost a weakening economy which is recovering slowly than anticipated after strict COVID-19 curbs.
Earlier this week, China's Premier Li Qiang met with executives from internet companies including Alibaba ( NYSE: BABA ) and JD.com ( JD ), urging local governments to provide more help to businesses.
The world's second larget economy has been easing its scrutiny on its major tech giants to help with economy's post-COVID recovery in recent months. Last week, People's Bank of China imposed fines on Ant Group and Tencent, marking an end to regulatory probes.
The CAC said that the rules encourage independent innovation of basic technologies such as gen AI algorithms, frameworks, chips, and supporting software platforms, carry out international exchanges and cooperation on mutual benefit basis, and participate in forming international rules related to gen AI.
The measures also indicate that where personal information is involved, the consent of the individual shall be obtained or other requirements which comply with administrative rules.
Providers should sign service agreements with gen AI service users who register their services, clarifying the rights and obligations of both parties, CAC added.
The agency noted that providers of gen AI services with public opinion attributes or social mobilization capabilities shall conduct security evaluations as per relevant national regulations and perform algorithm filing and cancellation filing procedures, as per the 'Internet Information Service Algorithm Recommendation Management Regulations.'
Where the provision of gen AI services originating outside China do not comply with laws and these new rules, the national network information department shall notify relevant authorities to take necessary measures to deal with them, according to CAC.
