ELV - Humana reportedly sues HHS over Medicare clawback rule

Humana ( NYSE: HUM ) has reportedly sued the US Department of Health and Human Services to block a recently finalized rule that allows the government to claw back money from private Medicare Advantage plans if it determines they were overpaid.
The healthcare insurer, which is a leading provider of Medicare Advantage plans, filed the lawsuit in a federal court in Texas on Friday. The suit, which is the first of its kind, could further delay an ongoing audit of payments that extends back to 2011, Bloomberg reported.
UnitedHealth Group ( UNH ), CVS Health ( CVS ) and Elevance Health ( ELV ) are also leading providers of Medicare Advantage plans.
The audit rule was finalized in January.
