Twitter ( NYSE: TWTR ) is expected to filed a lawsuit against Elon Musk over the billionaire's termination of his $44 billion acquisition of the social media company later Tuesday.
Twitter ( TWTR ) will likely filed the lawsuit on Tuesday, CNBC's David Faber said on the business network.
Twitter is set to battle with Musk over the deal termination as Bloomberg reported Sunday that the social media company has hired law firm Wachtell, Lipton, Rosen & Katz LLP as it prepares to sue Musk early this week.
On Monday Twitter's ( TWTR ) confirmed legal team of Wachtell, Lipton, Rosen & Katz has sent a letter to Tesla ( TSLA ) CEO Elon Musk, firing back at his claim that his $44B deal to buy the company has been terminated.
"Contrary to the assertions in your letter, Twitter has breached none of its obligations under the Agreement, and Twitter has not suffered and is not likely to suffer a Company Material Adverse Effect," the firm continues. It adds the termination is invalid for another reason: that Musk and his team have "knowingly, intentionally, willfully, and materially breached the Agreement."
Rosenblatt said Monday that Twitter shares could slip to $11 per share without the deal .
